BEHEMOTH Frontman Hopes DECAPITATED Members 'Strike Back Soon' After They Were Cleared Of Rape And Kidnapping Charges

January 9, 2018

BEHEMOTH frontman Adam "Nergal "Darski says that he hopes members of the Polish death metal band DECAPITATED "get their justice and strike back soon" after rape and kidnapping charges against them were dropped by prosecutors in Washington state.

Less than two weeks before the musicians were scheduled to go on trial for allegedly kidnapping and raping a woman on their tour bus four months ago, Spokane County prosecutor Kelly Fitzgerald filed a motion dismissing all rape and kidnapping charges. The motion cited "the well being of the victim" as a reason for dropping the charges without prejudice, meaning the four members of DECAPITATED could be prosecuted in the future.

On Monday, Nergal, a fellow Pole, took to his Instagram account to defend his colleagues, saying that they "couldn't" and "wouldn't hurt a fly," and lament the fact that they had to endure "such severe defamation."

Negal wrote: "Four months ago, DECAPITATED were accused of kidnap and gang rape. Subsequently, they were put in a county prison and later into a local jail… and the shit hit the fan! I recall the similar case of my friends from SATYRICON/KEEP OF KALESSIN who spent two months in a Canadian prison because someone accused them of rape. It took two months of legal bureaucracy and the help of the Norwegian government to get them out. The accuser finally recanted the allegations, claiming it was a mistake. They never received compensation for financial losses or emotional trauma, just a brief apology and a document to prove their innocence (which they must always carry around with them).

"Somehow, from the very beginning my intuition told me my friends from DECAPITATED would be just fine. Now, I'm not claiming to be a prophet but I'm an optimist and a good judge of character, I know these guys and I know they couldn't/wouldn't hurt a fly. They are now released and have had charges dropped (without prejudice). It's obviously a big relief to their families and friends, including myself.

"So… what's next for their career after such severe defamation? What about their good name? What about their families? I hope they get their justice and strike back soon!!!

"And justice for all? Well…not quite. But getting innocent people back home… HELL YES!

"Last thing, friends — stay rational and reasonable and think carefully before you speak... and cast a stone at innocent people.

"Welcome home, brothers."

A trial for the four men had been scheduled for January 16.

Defense attorneys questioned the credibility of the accuser, who in 2014 admitted to lying to police about injuries she sustained during an assault, when her boyfriend was accused of stabbing three people. It was later determined that she was actually injured by her boyfriend during a previous argument.

The woman alleged she was gang-raped by the musicians in their tour bus bathroom after DECAPITATED's August 31 concert with THY ART IS MURDER at The Pin concert venue in downtown Spokane as part of the two bands' "Double Homicide" tour. The woman said entered the bus for drinks with the band before each member forced themselves on her.

Deputies later stated the victim had "significant bruising to her upper arms consistent with being restrained" and "small abrasions on her knuckles that were scabbed over."

Andy Marsh, a member of THY ART IS MURDER, provided testimony for the defense, saying he saw the woman violently dancing in the mosh pit in front of the stage. "She was smashing her hands, arms and body against the metal barricade between the audience and the stage," he said in the court documents.
