Judge To Rule Next Month If METALLICA-Related Death Case Goes To Trial
January 5, 2007According to the Canadian Press, a judge will decide in February whether a case involving four teens charged with manslaughter following a dispute over METALLICA on an Edmonton, Alberta, Canada transit bus will go to trial.
Stefan Conley (photo),35, a passenger on the bus, died on March 2 of a head injury.
The preliminary hearing for the teens wrapped up today (Jan. 5) with defense lawyers calling for charges to be dismissed.
The Crown Prosecutor's office has acknowledged that Conley was the aggressor in the fight which broke out during an argument about METALLICA.
A 16-year-old girl testified Wednesday that Conley threw the first punch at one of the four later charged in his death.
She said he was aiming for a second punch when the boy and his three friends fought back, throwing punches to defend themselves.
Dr. Graeme Dowling, Alberta’s chief medical examiner, testified last month that Conley died when an artery at the base of his brain — no bigger than the lead in a pencil — sustained a pinhole tear.
The tear probably resulted from a blow to the face or chin, Dowling said.
A judge is to make a ruling on the case on Feb. 2.
